I think it probably has more to do with the expiration of the last agreement, which ended in September 2015 and was followed by a one year grace period under which no trade action could be taken. Pretty much right after that grace period ended (September '16), US industry groups applied to the DoC for new tariffs. I'm pretty sure if they could have sued in '14 when the dollar was at parity, they would have.
